Is the Criminal Justice System Bias Essay Abstract This paper will ask several questions and hopefully answer most of those questions. Questions like is the criminal justice system bias against the poor and is the criminal justice system bias against minorities. We then explore some of the possible solutions to the problems that could cause biases. We then look at a study done on several communities where relations between police and the public had repaired their relationship. Body It’s easy to understand why people see the criminal justice system as biased. Our of all of our states prisoners forty percent can not even read; and sixty-seven percent did not have full-time employment when they were arrested. So there are more uneducated people in prison then there are educated people. This seems like then that our system of criminal justice is operated on an unequal system against poor or uneducated people. However, one of the problems we run into when we try to compare the wealthy lawbreakers to poor lawbreakers is the wide difference between the amount of wealthy people and poor people we have in our population. â€Å"In 1989, the wealthiest one percent of United States households owned nearly forty percent of the nation’s wealth. The wealthiest twenty percent owned more than eighty percent of the nation’s wealth. That leaves precious little for the rest† (Cole, 2000). This isn’t just true with adults, but with children and teenagers too. The number of poor/under-funded schools in America far outweighs the number of wealthy schools in America. That’s probably the main reason our system appears to be unfair against the poor. The reason that any pole or nation wide research will be bias against the poor or lower class is because there is a much larger poor/lower class population than a wealthy/high class population. Most American’s will probably not want to believe that our criminal justice system is not operated on equality. After  all our nations Supreme Court even has the saying â€Å"Equal Justice Under Law† written above the entranceway. There are several very famous Supreme Court’s decisions that uphold equality for the poor. In Gideon v. Wainwright they made it a law that the state must provide a lawyer to all defendants who have been charged with a serious crime and cannot afford a lawyer. In Miranda v. Arizona the Supreme Court decided that police must provide all suspects with an attorney. These court decisions might be a little misleading since both were decided during the time of Chief Justice Earl Warren, who was strongly liberal and very supportive of economic equality. Since then the principles of equality from both decisions for Gideon v. Wainwright and Miranda v. Arizona have been cheated and twisted so that neither decisions are upheld to the full extent that they were intended (Cole, 2000). That’s enough bashing our court system. There are actually many things that police officers do witch can be biased. For example the Fourth Amendment says that we have a right against unlawful searches and seizures. However, police officers all the time and request their consent to search them or their belongings (without ever having any basis for suspicion) without ever informing them of their right to refuse the search. This isn’t necessarily a bias against the poor but it makes sense to me that an officer would judge somebody on appearance. There is also the means of transportation we have to consider if law enforcement is bias to the poor. Say hypothetically some wealthy person is traveling across the country to a birthday party. How are they going to travel? Most wealthy people would probably travel across country like that by means of flying. While flying, people do not come in contact with that many police officers nor are they in many positions where they would normally break the law. However, say there is a poor person who is traveling the same distance to the same party but does not have the money to fly. The cheapest mode of transportation is definitely by way of buss. While traveling by buss there is definitely a larger chance of contact with the police than when traveling by air. There are also many more opportunities for crime to be committed while traveling on a buss. Again we have the situation where it’s not necessarily that the poor are treated differently but are maybe just in environments where c rime is committed more often, which would explain why it seems that the system is biased against them (Rothwax, 1996) So I feel like we could come to an  agreement now that the criminal justice system is not necessarily biased against the poor at the law enforcement side of the criminal justice system. However, the courtroom side of the criminal justice system seems indirectly biased against the poor, simply because each trial can be different depending on how much money they defense and the prosecution have available to them. Now lets talk about other ways that the criminal justice system could be bias. What about race? Are people treated differently depending on their ethnicity? Most people probably agree that there are some ethnic groups who are treated differently than other ethnic groups in the criminal justice system. Statistically minorities are disproportionately victimized by crime. â€Å"African Americans are victimized at a rate of 150 percent higher than whites† (Cole, 2000). Blacks are typically more involved in almost every kind of crime more so than whites. These crimes can include rape, aggravated assault, and armed robbery. Homicide is actually the number one leading cause of death among young black men. Most crime is interracial and so it could be argued, just as it can with the topic of biases against the poor that the reason for higher crime rates for black is because most poverty stricken areas, or the inner city, have majority black populations. Therefore the criminals would be black, the victims would be black, and all the statistics that came from that area would rate blacks more prone to commit crime than whites. Now lets look at some cases. For instance the videotaped beating of Rodney King by Los Angeles Police Department officers was a huge eye-opener for most of America. It was said of that beating that for many blacks saw that as trea tment they expected from the police. They were not surprised by that beating what so ever. Curtis Tucker, a California Assemblyman, was quoted saying at a subsequent hearing on Los Angeles Police Department practices, â€Å"When black people in Los Angeles see a police car approaching, they don’t know whether justice will be meted out or whether judge, jury, and executioner is pulling up behind them.† There was even this one officer who earned the nickname â€Å"the Mechanic† because he would â€Å"tune people up† which apparently is police slang for beating up people. This â€Å"Mechanic† once testified that the beatings were widespread. When asked the question of weather he beat up people whom he arrested he replied, â€Å"No. We just beat people up in general. If they’re on the street, hanging around drug locations. Just—It was a show of force† (Rothwax,  1996). The officer even admitted that the majority of the beating victims were either black or Hispanic; although he claimed that the attacks were not motivated by racial tension. There have been very disturbing patterns of corruption and brutality in the police force of almost every high-crime area studied. These corrupt acts include stealing from drug dealers, engaging in unlawful searches, seizures, and car stops, even dealing and using drugs. If instances like this is what our police force has come down to then our country is far worse off then I ever realized. I do however believe that this is probably a much smaller percentage than what some statistics would lead us to believe but it is not a problem that I believe can be overlooked. So what can be done? Can something be done? Are we as a country so far gone that we can come back? I believe we can. I believe that we have become to far separate from the community. We have to bridge the gap that has grown between law enforcement/the criminal justice system and the public lower class people. How do we do that? â€Å"The thing we need most is perspective† (Walker, 1980). One thing that could be the answer to our problem is community based policing. In Canada they passed the Police Services Act of 1990 that might be a good refere nce for our current agencies to look back on. What the Police Services Act did was make the Chief of Police responsible for community-oriented policing (Kuck, 2004). â€Å"Community based policing is both a philosophy and an organizational strategy that allows the police and community to work together in new ways to solve problems of crime, disorder and safety. It really only has two elements: changing the methods and practice of the police and taking steps to establish a relationship between the police and the public† (Groenewald, 2004). The Philosophy of community based policing is based off of the idea that the public has a right to give their input on policing. It also relies on the idea that to find a solution for community problems both the police and the public must look past individual crimes and incidents, and instead try to find ways of confronting the more important community problems. What does community based policing look like though? Community based police officers need to be much more than mere crime fighters and must be public servants in many ways. Reforming the police alone, however, is not enough. Community support and assistance are also necessary. Community based policing therefore encompasses strategies to reorient the public who, for  good reasons, have been leery and distrustful of the police. Building partnerships between the police and communities is a major challenge that not many people or organizations have every really attempted. The philosophy of community based policing asks both the police and the public to take a leap of faith and a commitment to change. It would be a long process that would require drastic action to be taken at multiple levels meaning that there would be detailed planning necessary to turn philosophy into reality within the police and among the public. There was a study where Kuotsia Tom Liou from the University of Central Florida and Eugene G. Savage from Florida State University looked at the impact of community policing by looking at three neighborhoods in West Palm Beach, Florida before and after the implementation of a community oriented policing program. Lets take a look at what they found. They had 3 communities with the first consisting of mainly white residents, mainly single-family homes, apartments, and small businesses. The second community was primarily black consisting of a concentrated public housing project, single family homes, apartments, small businesses, several churches, and a public middle school. The last community consisted of whites, Hispanics, blacks, and Haitians. The community was made up of single family homes, apartments, small businesses, and several churches. It was their goal to find out how community policing affects difference types of communities. The results of their study showed that after the community based policing had been going on sixty-eight percent of surveyed citizens felt that crime had decreased. All age groups, race groups, and all three neighborhoods shared the belief that crime had decreased. Even if the crime rates had not gone down in reality it would still really help relations with police officers just that the citizens believe it had. In addition to the feeling like crime had gone down they also asked in their survey how they felt about the relationship after six months of the community policing. Among the respondents to the survey eighty-eight percent felt that the relationship between the police and their communities as getting better. We started this paper with the question of is the criminal justice system bias. We talked about the relationship between law enforcement and the public. We talked about one of the possibilities of how we could rebuild that relationship. We then looked at some research where a relationship was made better by use of community policing.  Hopefully we can use research like this to help make this world a more perfect world. The Coniston Massacre :: essays research papers

On the 29th o April, 1977 Captain Cook, commander of a British fleet, landed on the eastern shore of Australia, in an attempt to claim the land under the name of Britain. The land was to be claimed by Britain as a land where the British government could send convicts; in an attempt to ease the struggle in the over flowing prisons. Upon Cooks arrival, he was ordered to follow three rules of claiming a foreign land. They were; 1.  Ã‚  Ã‚  Ã‚  Ã‚  If the land was not claimed, owned or inhabited by another country or race, Britain could just claim the land as their own. 2.  Ã‚  Ã‚  Ã‚  Ã‚  If the land was already claimed or owned by another country or people, then Britain could easily ask to have, or more likely, purchase some of the desired land. Through under British law, they could not steal the land as their own. 3.  Ã‚  Ã‚  Ã‚  Ã‚  If the people who owned the land decided not to give or sell any of it, Britain could declare was on them, to most probably reveal the superior country. During, and after the war, under British law, Britain was still unable to claim any already claimed land as their own, without the permission of the owners. Cook used none of these methods upon his arrival of Australia. Upon his arrival of Australia the country was already inhabited by the local Aboriginal people. Even though Cook presumably had a knowledge of the laws of claiming land, he did not abide by them. The British settlers instead just took the land as their own, with no regard for the Aboriginal people, starting a war, of sorts, that continues to this very day. (Board of Studies, NSW) White settlers moved into Central Queensland in hopes to find suitable land for their cattle to graze on. In their search this, much like the majority of the other land that had been â€Å"Settled† was inhabited by the local Aboriginal people. Again, much like the other portions of land that had ‘settled’, the ‘white settlers’ took the Aboriginal people with no regard, killing and wounding them as a way to claim the land. One of the vile acts that the white people did to the Aboriginals during those times was the raping and sexual mistreatment of many of the Aboriginal women. Probably the worst group to commit such acts was the Frasier Brothers. Boys who grew up on a station raped countless, some what defenceless, women, with no conscience or remorse.

Contemporary Australian Cultural Issues in the works of Harper Lee Essa

Harper lee examines key cultural issues in her novel to kill a mockingbird, such as racism, socio-economic status and prejudice. These issues are still relevant to contemporary Australian society. She examines these issues throughout her book in many different ways, from many different points of view and from many different opinions from the characters in the book. The book is set in a small town called Maycomb in America and takes place during the depression years. The town of Maycomb is a town which is old and is not well looked after and is described as dirty in the book. The people who live in and around Maycomb on farms are poor people, as a result of the depression. The main characters of the book are the finches. The Finch family comprises of Atticus the father and his two kids Jem and scout who narrates the story. The story is about life in maycomb seen through the eyes of children. Life in Maycomb is full of issues such as racism, socio-economic status and prejudice. Racism and socio-econic status are easily the two most noticeable issues that the book revolves around. These issues are relevant to contempory Australian society in many different ways. Socio-economic status is the main theme at the start of the book. A good example of this issue is when Jem invites Walter Cunningham to have lunch with himself, Scout and Atticus, because he does not have any lunch money as his family is too poor to afford it. They sit down for lunch and Walter drenches his food with syrup and scout thinks this is ungrateful and rude so she remarks by asking him what the Sam hill he is doing. Walter was embarrassed and Atticus shakes his head at her and she protests â€Å"but he has gone and drowned his dinner with syrup,† â€Å"he’s poured it al... ...ou only have to look at the wars going on over in the Middle East. They are all fighting over different religion which is racism. Terrorist attacks are also based on racism because a group of fanatics from all over the world do not like westerners this is racism. On a more local level you see it even at school where racism is big because Griffith High School is such a Multicultural community, all the different groups of people are grouped together for example the Afghans and the Islanders, this starts fights and arguments between different races. Socio-economic status and racism are only two issues that Harper Lee examines, as there many more which include prejudice, maturity and growing up. Harper Lee’s issues that are discussed in her book to kill a mockingbird are still contemporary issues in Australia, because they affect us and have a significant impact on us.

Manage Domiciliary Services Essay

As a healthcare provider we have to ensure we have the correct amount of staff as well as staff with the right skill set and qualifications on shift which meets the needs of the people we are supporting. We do this by implementing standards from the beginning which includes the recruitment process. Our recruitment is robust but is constantly changing to ensure potential new staff are people that is right to be in healthcare, someone can fail at any time of the recruitment process. Our recruitment process includes: 1. Telephone Interview 2. Face to face Interview 3. 2 Day mandatory Training 4. Induction and final interview 5. 12 weeks probation Indicators that a potential new member of staff can fail in our recruitment process: a. Not understanding the importance for a client to maintain their independence b. Not understanding the importance for a client’s dignity and respect c. Not understanding the importance of working over a 7 day period d. Not participating in activities in mandatory training e. Not completing the Common Induction Standards f. Not completing courses in the 12 week probation period g. Not meeting the levels of reliability set out All members of staff that do not have a NVQ 2 when starting with E-Spire Healthcare must complete the Common Induction Standards within the first 12 weeks of commencing work with the company, after this period they can then proceed with NVQ level 2, which is encouraged, we rely on our local college to provide this support. When a new member of staff starts with E-Spire Healthcare they must first complete induction and shadow shifts without senior staff, only once the senior member of staff has signed them off as competent will they commence their shifts with our clients. This way our senior is able to introduce the new member of staff to our clients but they also have a complete understanding of our client’s needs and what support they require. Depending on the complexity of our client’s needs will depend  on which member of staff works with our clients, for instance somebody who has mental health issues will not be asked to complete shifts with that particular client until they have completed the relevant training courses and completed shadow shifts and been signed off by the senior member of staff. There is no maximum number of shadow shifts that a new member of staff needs to complete, this will depend on the individual member of staff, their past work history, qualifications. Myself or the senior member of staff would of completed the necessary paperwork before the commencement of the package including the care plan the client’s needs, support, risk assessments, medication, and emotional support plans, this way we already have an idea of what type of member of staff will work well with each particular client, as I feel this is a two way process the client and the Support Worker must be able to work together so the client can be motivated to keep their independence but also the Support Worker to enjoy working with each individual client and know they are supporting in the correct way and making a difference in their day to day lives. We also at the paperwork stage will know how many members of staff are required for each shift. Consistency of care is an extremely important factor for us, not only for the client but also the support worker: For the client: 1. They will get to know the member of staff 2. They will be able to open up to them if they have any certain problems 3. They will know that the member of staff understands their needs 4. They will know that they won’t have to keep explaining how they like specific tasks like to be completed 5. There will be trust between the client and member of staff 6. Personal care tasks will hopefully not be seen as daunting as the same person is with them 7. Trust when it comes to supporting people with their medication For the Support Worker: 1. They will get to know the individual client 2. Will understand how they like tasks to be completed 3. They are confident with how to support individual clients 4. They understand what motivates each individual client And many more reasons. Each individual client has a series of risk assessments completed for the  commencement of support package. This will include, medication, mobility, feeding, personal care as well as the immediate environment that the support worker will be working in. Depending on the individual client will determine how many members of staff will be required. This can depend on their mobility, their mental health, support in the community. If we feel that a package requires a different amount of staff to what is stated from for instance the social worker, we will go back to them and state our findings, but a package will not start until we have the correct amount of staff on each shift, as we need to keep both the client and our staff safe from injury and harm as well as the community too. I have a completed risk assessment attached with this document all personal details have been removed. E-Spire Health care have clear recruitment guidelines in place which all office staff know and understand a nd all abide by. No member of staff can commence with any shadow and induction shifts until we have on file: 1. Phone Interview 2. Face to Face Interview 3. 2 Day Mandatory Training 4. Induction and Final Interview 5. DBS 6. 2 references 7. Staff Members folder signed off by either myself or the director Carl Boulton. We have a excel document which is kept up to date of any potential member of staff that has approached E-Spire Healthcare this way we can ensure that we are not bringing anybody on board that has already tried to get through the recruitment process already. We also have a flow chart so we can refer back at any time if we are ensure of the process. Within healthcare we are supporting clients within their homes or a residential setting, so our staffs reliability and time keeping is essential, however with this said we will always occur a percentage of lateness and sickness, although we do have a procedure to monitor this and we will speak to any member of staff that does not hit the E-Spire targets ( separate occasions of illness within a 6 week period and also the same for lateness), as a company we do need to be prepared for the unexpected and people can fall ill at any time, this is why we have senior staff that their day to day roles  are shadow and inductions, reviews but to also pick up shifts at any time, we also have a deputy manager who also is able to go out and do shifts at any time. If need be there is also myself to go out to do shifts, but the same procedure applies to us too we must of completed shadow shifts with each client we will be going to, this is why shadow shifts and inductions are so important. Every client is an individual and their needs can change at any time, this can include cancelling shifts due to unforeseen circumstances such as going to hospital, doctor’s appointments, holidays, day trips out. It is our job to ensure that they are able to participate in any activity they need to. Hospital admission for instance is we will keep their shift slot open until they are able to come home, I know how important it is that when someone is able to come home, that they just want to come home, I do not want to be the reason why they are not able to come home, again this is a reason why we have senior staff available this way we can support clients with their task that is important to them. At E-Spire Healthcare and more importantly for myself I don’t want to meet CQC guidelines I want to exceed them, I am not in care to just give everyone the basic needs, I want to be able to provide support for people that is going to enhance their lives, maintain their independence, be emotionally supportive, and support them with the tasks that they need support with. Everything I do I also ask the same question â€Å"is this the type of support that is exceeds my expectations for my parents?† we monitor this by reviewing our clients care plans, speaking to them to see if they have any comments or complaints, asking them to complete questionnaires, which allows us to compile reports to see as a company where we can improve, because I feel we can always improve, if you’re not improving you’re not listening to people. We also complete a 12 week supervision for new members of staff, this goes towards their probationary period, this is a two way meeting with myself and the member of staff to both discuss the progress of the member of staff, it also gives the member of staff to give their opinion on subjects such as training, the clients their progress their needs. It is a document that will remain in each individual’s folder and it is a document that we are both able to refer back to, it includes: The member of staff role and responsibilities How the member of staff is meeting the company’s objectives and targets Any other training the member of staff feels they need to do Any problems the member of staff may have.  We then complete a target list of training and objectives for the member of staff to complete in the next 6 months, the next supervision would then not be with me as if the member of staff had an issue with myself they would then have the chance to discuss this with another member of staff. I feel this is a fair way to conduct supervisions, as the member of staff may feel more comfortable speaking to another member of the office team, but this way we are still able to improve for everyone. I am so the trainer for E-Spire healthcare but we also use other companies that are open to us which includes: 1. Local Colleges 2. Local District Nurses 3. The local authority I have attached my mandatory training course topics which indicates what is covered over the two days. To prepare myself for the training course I use a multitude of sources which are available to me, so I am fully informed so my information is up to date and informs and skills each individual member of staff so they have the knowledge to be practicable and skilful within their job role.
